Welcome to Letterman Fit! These Terms and Conditions ("Terms") govern your use of the Letterman Fit app (the "App") and related services (collectively, the "Services") provided by Homestead Labs, Co. ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the App.
By using the App, you represent and warrant that you meet the eligibility requirements.

2. Use of the Services

You are responsible for your own account and all activities conducted through it.
You agree to use the App solely for personal, non-commercial purposes.
You agree not to engage in any behavior that could harm, disrupt, or interfere with the App or other users.

3. Health and Safety Disclaimer

Consult Your Provider: You acknowledge that the workouts and fitness programs provided through the App are for informational purposes only. You should consult a physician or healthcare provider before starting any new exercise program.
Assumption of Risk: By using the App, you assume all risks associated with your participation in physical activities and agree that your use of the Services is entirely at your own risk.
No Liability for Injuries: The Company is not liable for any injuries, health issues, or damages arising from your use of the App or participation in workouts provided by the App.

4. Content and Intellectual Property

Ownership: All content, trademarks, and intellectual property in the App are owned by Homestead Labs, Co. or its licensors.
User Content: By sharing content (e.g., custom workouts, progress updates), you grant us a non-exclusive, royalty-free license to use, display, and distribute your content within the App.
Prohibited Content: You may not upload or share content that is unlawful, harmful, or violates the rights of others.

5. User Conduct

You agree not to:
- Violate any laws or regulations.
- Engage in harassing, abusive, or harmful behavior.
- Attempt to gain unauthorized access to the App or its systems.

6. Modifications to the Services

We reserve the right to modify, suspend, or discontinue the Services at any time without prior notice.
We are not liable to you or any third party for any modifications, suspension, or discontinuation of the Services.

7. Termination

We may suspend or terminate your access to the App if you violate these Terms.
Upon termination, your rights to use the Services will immediately cease.

8. Limitation of Liability

To the fullest extent permitted by law, Homestead Labs, Co. shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Services.
Our total liability to you for any claims related to the App shall not exceed the amount you paid for the Services in the past six months (if any).

9. Indemnification

You agree to indemnify and hold harmless Homestead Labs, Co. and its affiliates from any claims, damages, or losses arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the App or via email. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
